John W. Whitehead, Constitutional Attorney

“Mass shootings have become routine in the United States and speak to a society that relies on violence to feed the coffers of the merchants of death. Given the profits made by arms manufacturers, the defense industry, gun dealers and the lobbyists who represent them in Congress, it comes as no surprise that the culture of violence cannot be abstracted from either the culture of business or the corruption of politics. Violence runs through US society like an electric current offering instant pleasure from all cultural sources, whether it be the nightly news or a television series that glorifies serial killers.”—Professor Henry A. Giroux
This latest mass shooting in Las Vegas that left more than 50 people dead and more than 500 injured is as obscure as they come: a 64-year-old retiree with no apparent criminal history, no military training, and no obvious axe to grind opens fire on…

Enough is enough. It’s epidemic. It’s dangerous. And the time has come to demand its end.
In the aftermath of the horrific massacre in Las Vegas, America needs fallacy control. Yes, we must declare war on fallaciousness. Now more than ever, the nation is suffering from an outbreak of illogical thinking.
In response to senseless violence, clearheaded citizens deserve a safe space from the 24/7 barrage of rhetorical nonsense. Let’s break down the collective cognitive breakdown.
Argumentum Ad Celebritum
Empty talking points don’t become persuasive arguments when uttered by Hollywood stars. But in the bizarre land of the celebrity cult, late-night comedian Jimmy Kimmel has been suddenly anointed “America’s conscience” and “voice of reason.”
Kimmel railed “intensely” on TV Monday night against politicians doing “nothing” to stop mass gun violence. Sobbing and emotional, he insisted, “there’s a lot of things we can do about it.”
Yet, Kimmel acknowledged that Mandalay Bay gunman Stephen Paddock had passed multiple, mandated background checks and had no criminal history.
Moreover, Paddock bought his guns legally from Nevada and Utah gun shops subject to a thicket of local, state, and federal rules—and reportedly carried 23 of his weapons into a casino/hotel that already operates as a gun-free zone.
Federal studies show that a measly 1 to 3 percent of all guns are purchased at gun shows, but that didn’t stop Kimmel from tossing around non sequiturs attacking the “gun show loophole.” It’s a mythical exemption in federal law for private weapons sales at gun shows or online intended to drum up hysteria about unregulated gun sales.
In reality, firearms purchased through federally licensed firearms dealers at gun shops, shows, garage sales, or anywhere else are subject to all the usual checks and restrictions.
Only a narrow category of same-state transactions between private individuals not engaged in the commercial business of selling firearms (family members or collectors, for example) are unaffected by those regulations.
There is zero empirical evidence that banning these types of transactions would do anything to prevent gun crimes or mass shootings.
But who needs evidence when Jimmy Kimmel is bawling on stage “intensely”? The tears of a clown outweigh the sobriety of facts.
Argumentum Ad Populum and Argumentum Ad Hashtag
Actor Billy Baldwin unloaded a fallacy two-fer with his assertion that “the overwhelming majority of Dems, Reps & NRA members endorse #GunSafety,” so “how can we let the #NRA hold us hostage like this? #NRATerrorists.”
Claiming that an “overwhelming majority” of people agree with you doesn’t make your argument sound. Nor does citing polls showing support for “gun show loopholes” that those surveyed don’t fully understand.
Nor does attacking the character of your political opponents and hashtag-smearing them as “NRATerrorists” for holding political viewpoints different than your own.
Straw Men and Red Herrings
Grossly oversimplifying support of ineffective or superfluous gun control measures as “#GunSafety” allows celebrities, politicians, and activists to prop up their favorite hollow debating tactic: asserting that gun owners, NRA members, and Republicans don’t care about gun safety and want more innocent people to die.
Democrat Rep. Ted Lieu of California illustrated a similar diversionary tactic by waving the red herring of a “gun silencer bill” and demanding that GOP “COWARDS” vote against deregulating such suppressors.
Hillary Clinton also demagogued the issue, ghoulishly tweeting: “Imagine the deaths if the shooter had a silencer, which the NRA wants to make easier to get.”
Her running mate and Virginia Sen. Tim Kaine parroted the propaganda, claiming that Paddock “was only stopped because he didn’t have a silencer on his firearm, and the sound drew people to the place where he was ultimately stopped.”
Police, however, took 72 minutes to locate Paddock; it was the sound of hotel fire alarms set off by all the gun smoke that led them to the shooter. But let’s not let pesky facts in the way.
Think of the Children
Invoking kids to support one’s public policy preferences is not an argument. It’s a timeworn appeal to emotion. Without it, however, gun control advocates are all out of ammunition.
“We as a society owe it to our children” to pass “common sense” gun control, New Orleans Saints coach Sean Payton pleaded.
“Thoughts & prayers are NOT enough. Not when more moms & dads will bury kids this week, & more sons & daughters will grow up without parents,” Sen. Elizabeth Warren, D-Mass., fumed on Twitter.
And actor Boris Kodjoe tweeted: “My 10 year old asked me how the shooter was able to get his machine gun. I told him that pretty much anyone in the US can. ‘But why daddy’?”
Too bad Kodjoe’s kid will never know that daddy didn’t tell him the truth about fully automatic firearms (aka “machine guns”), which have been effectively banned from private civilian ownership in the U.S. as a result of federal gun legislation dating back to 1934.
Nor will the children of the “Think about the children!” brigade be taught the truth about defensive gun use or Second Amendment history and jurisprudence.
We owe our children critical thinking skills and evidence-based public policy, not knee-jerk slogans and tear-jerking treacle.

U.S.A. –-(Ammoland.com)- There has been a lot of rumors and talk about what is going on on November 4th 2017. Some people have even been saying that there is a planned overthrow of the US Government by Antifa or other groups. The truth of the matter is a more nuanced.
Since my writing my exposé on Antifa, I have been getting multiple messages through email and twitter asking what I knew about this “plan.” I started reaching out to my contacts and doing a little digging into the matter at hand. This information is what I was able to find out.
There is a planned protest on November 4th 2017 by a group called refusefascism.org. The goal of this movement is to protest until Trump and Pence step down. Before we can say what exactly is going on, we need to know who we are dealing with to access the threat correctly. I started my research to answer the fundamental questions of what, who, when, and why.
Looking at DNS whois records didn’t give me any information about the group since they used a private registrar service. I then noticed that they had a physical address listed on their web page. I did a historical web search for other sites that used the same address because nothing is ever actually deleted from the web.

The first thing I noticed a bunch of anti-capitalism websites. Another thing I noticed was a lot of pro-communist sites. All these sites used the same cookie cutter WordPress templates.
Upon further digging on all these sites I was able to trace them back to Revolutionary Communist Party located in New York.

We’re Leading Up to the Big Show

October is a time for patience and strategy. (Shutterstock/Jim Cumming photo)
Similar to September, the month of October is full of change in the deer hunting world. But as for that “October lull,” it’s a big pile of nonsense. Instead, it’s actually a misinterpretation of perceived deer behavior. When reality is much different.
Food sources continue to change. Deer behavior and travel patterns change with it. Hunting pressure is becoming more of a factor. Bucks’ testosterone levels are rising. Deer are preparing for the rut. It’s a momentous — and crazy — time in the deer woods.
But one thing is for sure, there is no “lull.” In fact, the science shows that deer activity (including daylight appearances) actually increases throughout the month of October. So, think of October as a slow progression. Here’s how you can take advantage of that and approach it on a week-to-week basis this season.
We might as well still be hunting in late September. Things haven’t changed much from the last week. Or have they? On the surface, it’d appear as if they haven’t. But I assure you that isn’t the case. The wheels are turning, bringing us closer to the rut.
There hasn’t been a huge change in food sources. Deer are still transitioning off some of the lush, green food sources they’ve been feasting on and are now seeking out pockets of hard mast and other fall food sources. Transitioning with the deer is key to success.
The biggest change? Bucks relocating to their fall ranges. About half of all bucks will spend the fall in a different location than they did summer. This behavior started happening in late September and should continue to occur until the middle of the month.
Rut sign is also becoming more prominent across the landscape. Now is the time to really get out there and (carefully) scour the landscape for fresh rubs, scrapes and tracks. Use what you find to help paint a picture of what the deer are doing at the time.
Things are a little more heated now than they were a week ago. But we’re still a couple weeks out from the real October action. That said, it doesn’t mean you can’t score during the middle of the month. I killed a very mature 8-pointer toward the latter end of this week last season.
My advice for hunting this period? Continue to focus on food. That’s key regardless of the week or phase you’re hunting. Don’t camp out over rut sign unless you know deer are frequenting it during daylight. Instead, use it to help connect the dots.
Also, think about the weather and temperature. The first true cold front and temperature swing of October can be a prime time to kill a reclusive deer. There’s just something about it that gets deer on their feet. Be prepared to sit in the tree when you see these conditions on the horizon.
Again, things are ever-so-slightly warming up. I said it’s a slow progression. And most years, a slow progression it is. Patience is the key when hunting during the month of October. Don’t rush things. Don’t get super aggressive. Bide your time. Move in and strike when the conditions are right. Stay back and observe from afar when they aren’t. Truly successful hunters are incredibly adept at recognizing a window of opportunity.
By now, most bucks have relocated to their fall range. And interestingly enough, most bucks are loyal to and won’t leave their home range by mid to late October — even if pressured and bumped by hunters. On the flip side, I’ve experienced numerous times that the same amount of pressure can uproot a buck prior to the middle of October. I don’t fully understand why this is the case. Maybe they’ve invested in the area and don’t want to leave it this close to the rut. Maybe they feel as if their security measures were successful since they detected you before you killed them. Regardless of the reason, the results are often the same.
During this week, continue to focus on food. But avoid the major feeding destinations and focus on smaller, more secluded food sources. I also like to set up in or near staging areas. This has proven to be a very useful tactic throughout my years in the deer woods.
Now we’re starting to see a little action. Younger bucks are starting to chase does. Big bucks haven’t really started chasing, but they’re certainly up on their feet more — checking scrapes, freshening rub lines and searching for that first estrus doe.
The end of October (and beginning of November) is generally when you’ll see the most rut sign. Bucks are completely frustrated by now. Their testosterone levels will soon peak, but does haven’t become very receptive just yet. It isn’t uncommon to catch bucks on their feet in daylight because of it.
Personally, I continue to hunt during this seven-day period exactly as I did the week before. Things haven’t really changed except the likelihood of seeing deer in daylight has increased. And remember, continue to be patient. Things are about to bust wide open within the next two weeks.
Weather and temperature permitting, these are the best three days of October. Halloween day hasn’t received the grand reputation it holds for nothing. This is the time to be in a tree if you’re a bowhunter. Bucks are on the move. And if they aren’t, it’s likely because temperatures are higher than average and the weather has been stagnant.
In most places, bucks still haven’t ventured far from their home ranges or core areas. But the likelihood of seeing them in daylight near their core area is high. You just have to be in the right spot at the right time to intercept them. And don’t be afraid to implement tactics including decoying, calling and rattling.
For those who have kept tabs on a specific buck, now (and the first few days of November) is the time to strike. It won’t be long before bucks start covering every inch of their home range, and even venturing outside of it. If you have a deer pegged, and the conditions are right to move in, do so. If you don’t, it won’t be long before you run the risk of another hunter killing it on a neighboring property.

TROY, N.Y. — A man says he was attacked by a rabid deer in upstate New York, and it nearly stabbed him in the eye with its antlers.
Tony Remillard, 34, of Troy, was in his backyard earlier this week when the 10-point buck jumped his fence and attacked him. The Albany Times-Union reports the encounter left Remillard with a black eye and a facial gash that required eight stitches to close.
Remillard says he’s grateful the blow from the deer’s antlers wasn’t higher, as it would have punctured his eye.
Remillard says he was able escape when a neighbor drove up. The deer also ran off and was later found dead by a state Department of Environment and Conservation officer.
A DEC spokesman says the deer carcass tested positive for rabies.
