Dershowitz said “this is a very sad day for justice” and that Mosby acted out of a “desire to prevent riots.” It will be “virtually impossible,” he predicted, for the six officers involved to get a fair trial.

And as for murder charges, Dershowitz said there’s “no plausible, hypothetical, conceivable case for murder” and “this is a show trial.” He predicted that Mosby might get removed as prosecutor and Baltimore citizens may get upset if and/or when they “move to a place with a different demographic.” (link)

35-year-old political activist and State Attorney, Marilyn Mosby, chose to file charges via direct Criminal Information Probable Cause Affidavit (PCA) as opposed to seeking an indictment via Grand Jury.

However, under Maryland criminal procedure all defendants are ENTITLED to a preliminary hearing within 30 days.  At the preliminary hearing a judge will determine whether there is validity to the defendants and the charged felonies.

Even though she originally chose to file charges via Criminal Information, she will still likely try to seek an indictment via a Grand Jury between now and the 30 day window for the preliminary hearing.

Strategically, the indictment, if any, will likely be issued on the eve of the preliminary hearing as a way of preventing the defense from obtaining “free discovery” and notice of the prosecutors trial theory.

The announcement today appears to be PURE POLITICS to appease a mob.  Mosby choose the Direct Information route with charges simply to get the six officers arrested right away.

State Attorney Mosby can change the charges before she seeks an indictment before the grand jury approximately 30 days from now.  Or, the Grand Jury can refuse some elements of the indictment.

Wow- 13 whole grams? An ounce of weed weighs 28 grams. This guy gets labeled as felon for 13 grams of weed?! Whether you agree with legalizing weed or not-this is pure,unadulterated bullshit-it’s a freakin’ plant,people do not get addicted to weed-no one has ever died of an overdose of weed.Unlike heroin-which is killing young people at an alarming rate,is addictive,creates more crime because junkies will rob,steal,lie cheat,do anything for that next shot of dope-and we have to “War on drugs” focused on weed-WTF? Focus on meth and heroin-drugs that destroy lives,and stop sending people to jail/prison for weed. Weed helps people who are suffering in pain,it helps caner patients to eat,along with relieving their pain,it helps people with seizures. 

The war on drugs can not be “won”- whenever there is a demand for something-legal or illegal-someone will find a way to supply whatever product is in demand-prohibition proved that it didn’t work for alcohol-and it won’t work for drugs.

Pot smokers aren’t out robbing and stealing to support their drug habit-they’re not crashing cars while drunk,and killing themselves and others-it’s long past time to end the war on drugs,disband the DEA,stop seizing money from innocent people because banking law/rules/regs designed to catch drug dealers is not catching drug dealers-it’s catching small business owners who deposit money daily or weekly that fits the criteria of drug dealers depositing money in small amounts. No more felony charges for small amounts of weed,no more seizing cash beause of the way small business owners deposit their money,no more seizing cash during traffic stops-enough of this bullshit.

A north suburban man faces a felony drug charge after police found nearly 13 grams of cannabis in his Wilmette home Thursday night.

The agency hasn’t charged McLellan with any crime, but under controversial civil asset forfeiture rules the burden of proof is on him to prove he didn’t violate the “structuring” laws. The video was made by the Institute for Justice, a libertarian public interest law firm that is representing McLellan.

For the last few weeks, I have been quiet. This silence has extended to generally ignoring television broadcasts and mass media for awhile. There have been personal affairs which have occupied my attention, but no more. The Baltimore riots have finally succeeded in penetrating that self-imposed veil.

A Liberal acquaintance of mine accidentally hit upon a fundamental truth. He linked to this little gem from Salon: Baltimore’s violent protesters are right: Smashing police cars is a legitimate political strategy. Now, before you think that I’ve gone off my rocker and moved over to the Progressive side, consider that I am not commenting on the morality or rightness involved in the act. Francis has completely demolished any pretense of morality or uprightness on the part of the protesters, or their political masters. He has done a more thorough job of denouncing that than I can do.

No, what I’m saying is that this is a carefully calculated political act of violence on the part of the Left. There is another word that meets the definition of “political act of violence,” and that is WAR.

Salon’s Leftist writers have inadvertently revealed the truth: America is at war with itself. The Civil War has already begun, but like the quiet lull after the first shots across Fort Sumter, this is only the opening act, and many people on both sides still cling to the delusional notion that things can go back to the way they were, that peaceful compromise is still possible. This woman, admirably berating her foolish son out in the open for participating in the riots, might think so. But individuals like her are few and far between in the current unpleasantness.
