COQUILLE, Ore. (AP) – Voters in Coos County overwhelmingly approved a ballot measure that seeks to prohibit enforcement of new gun laws.

With most votes counted in Tuesday’s election, the initiative was passing 61 percent to 39 percent.

It follows a new state law that requires background checks for private, person-to-person gun sales.

The measure seeks to prohibit the use of county funds to enforce the background-check mandate or other new gun restrictions that may pass in the future. It also directs the sheriff to determine whether gun laws violate the state or U.S. constitutions.

The initiative was proposed by an optician from Bandon who says the background check mandate infringes on 2nd Amendment rights.

Legal experts say the court system is the proper venue for sorting out constitutional rights.

According to a usually informed source, both CNN and The Associated Press are in possession of previously unreleased evidence related to the Twin Peaks Massacre last May.

The evidence has been presented to a grand jury currently convened in McLennan County and includes materials that have not yet been discovered to defense attorneys in the case. The evidence includes an affidavit by a Waco police detective who testified that a Texas Department of Public Safety “covert camera” recorded a member of the Cossacks Motorcycle Club “executing” a member of the Bandidos Motorcycle Club.

At a bond reduction hearing on June 5, Assistant District Attorney Michael Jarrett referred to the covert camera video and said it showed “Bandidos executing Cossacks and Cossacks executing Bandidos, some at point-blank range.” Jarrett described the video in detail at that hearing. He said it showed Cossacks arriving and occupying the patio of the Twin Peaks then “spreading out across the patio in sentry positions.” Jarrett is leading the grand jury that will decide which of 177 defendants will be indicted for murder, criminal conspiracy and other charges. The covert camera video has not yet been released to defense attorneys in the case.

The usually informed source did not speculate who leaked the evidence but volunteered that although the major news sources have “all of this evidence, they are not reporting anything positive for the Bandidos.”

FBI

Ann O’Neill, Ed Lavandera and Jason Morris of CNN have reported that “FBI agents in San Antonio and El Paso picked up intelligence that the Bandidos were planning to go to war with the Cossacks.”

The three CNN reporters also allege that “The Bandidos made a crucial decision on March 27 of this year, moving the regular meeting of the Confederation of Clubs and Independents from Austin to the Twin Peaks restaurant in Waco,” and that “Waco police feared, with good cause as it turned out, that the May 17 meeting would trigger violence.”

Coverage of the incident has been so largely dominated by police and Cossack accounts that it is impossible not to suspect an interconnection.

The day after the deadly confrontation, a Cossack named Scott “Scoot” Keon told the Palestine, Texas City Council that his club was law-abiding and the Bandidos were not. “On our side, we are not a gang,” Keon said. “We are an organization that is Texas-wide. None of us are one-percenters.”

Keon blamed the Bandidos for the massacre. “There are things that they (the Bandidos) are involved in that we have no interest in,” he said. “We are businessmen, family men, and veterans and are in no way affiliated with them. We won’t be pressured into paying them dues, and that’s where their anger is coming from. Just because other clubs have given in, doesn’t mean we are going to.”

Published Accounts

All published first hand accounts of the massacre in which nine men died and 18 more were hospitalized have relied on statements made by Cossacks.

On May 23, The Washington Post ran a lurid account of the confrontation titled “‘Richie died, then Diesel, then Dog’: An eyewitness to the Waco biker brawl.” The eyewitness was a Cossack who was “president of a North Texas chapter of the motorcycle gang.” According to the well known Washington daily, the single source for the story “asked not to be identified because he is now in hiding and said he fears for his life. He is a rare eye-witness speaking publicly about the Waco massacre.”

On June 20, the Houston Chronicle ran an even more lurid first hand account titled “Life and death in Waco: A biker’s story.” That feature described the Bandido “execution” of Cossack Danny “Diesel” Boyett. The principal source for that story was Boyett’s son Cody Ledbetter. The account describes an unprovoked attack by Bandidos on Cossacks who had come to the Twin Peaks that day to talk peace. The story, by Dane Schiller, states, “A law enforcement officer familiar with the clash at Twin Peaks and well-versed in motorcycle gangs said Ledbetter seems to be telling the truth.”

The recent CNN coverage of the incident has relied on statements made by John Wilson, who is described as “president of the Waco-area chapter of the Cossacks.”

Wilson, not surprisingly, describes the Cossacks as victims of the Bandidos. According to CNN, “many Cossacks and their supporters said they were invited to the meeting and told it had been called to broker peace. Now they’re wondering if they were set up.”

Wilson has described the confrontation on camera, in detail for the cable network that describes itself as “the most trusted name in news.”

“I couldn’t even see who threw the punch. But I saw our guy’s head go back, and it looked like he was getting ready to punch back whoever did it and a shot went off.” Wilson told CNN there were “a couple more shots, some scuffling around and then, almost instantly, gunfire just erupted from all around the perimeter.”

“I promptly got down on that sidewalk trying to avoid being hit myself. At that time it was pretty horrific, there were guys getting hit, falling, and I realized that I needed to get away from where I was. I looked to the guy to my left, a good friend of mine, and said, ‘We need to get off the sidewalk or we are going to die here.’”

None of these dramatic accounts has been viewed skeptically. CNN has not questioned who fired the shots that “erupted from all around the perimeter.”

The Police

During a bond hearing, Wilson’s attorney Mike White told Judge Ralph Strother that Waco police “actually advised him to begin a dialogue to try to lower the tension that had been preceding this event (the May 17 Confederation of Clubs and Independents meeting) for numerous weeks…They suggested that he either go to this meeting or start some dialogue or start having sit-downs with opposing motorcycle clubs.”

The police “suggestion” came at least weeks after the Confederation of Clubs and Independents decided to move its meeting from the Twin Peaks in Austin to the Twin Peaks in Waco. Representatives of the Confederation have said the meeting was moved to make it easier for members from the Dallas area to attend. The only basis for the theory that the meeting was moved to Waco to send some sort of message to the Cossacks is police conjecture. If it was meant to be a show of force by the Bandidos it is likely that the Bandidos would have made the Waco event a mandatory run. The whole argument that the Bandidos instigated the confrontation only sounds reasonable to people who know nothing about the very punctilious world of motorcycle clubs..

Most Cossacks, and most members of Cossacks friendly clubs like the Scimitars and Bogatyrs learned about the Twin Peaks run long after police learned that the Confederation would be meeting in Waco.

About March 27

What happened, exactly if not in totality, according to legally obtained police reports, was that the Texas Department of Public Safety learned that the COC&I was coming to Waco on March 27. They learned this from a Lorena, Texas Police Officer named Shawn Board who got his information from confidential sources of information. “Officer Board explained that the COC is run by the Bandido OMG. Officer Board further explained that the COC is where other motorcycle clubs are required to join and pay dues to the Bandido OMG to be able to operate in Texas. Officer Board felt like the change of the meeting location was purposely done to show support for the Bandido OMG in the Waco area to the Cossacks MC.”

How officer Board learned this remains an official secret.

Waco police and DPS agents then made contact with John Wilson on April 16, a month before the Twin Peaks Massacre, and told him that he was in danger.

Let’s Have Brunch

Then, purely by coincidence, 30 – 40 Cossacks as well some number of Scimitars and Bogatyrs arrived at the Twin Peaks well before the scheduled start of the COC&I meeting and stole all the seats and most of the parking spaces. As about a dozen Bandidos and scores of Bandidos supporters rode into the Twin Peaks parking lot, a Cossacks prospect named Clifford Pearce told the pack to find somewhere else to park. Local police were well aware the pack was coming. At 10:30 that morning, Texas DPS agents observed the pack assembling at the Flying J Truck Stop in Waco. Local and state police had assembled a large and heavily armed force, including a Bearcat armored vehicle, to “gather intelligence” at the meeting.

Seconds after Pearce told the Bandidos to park somewhere else he was reinforced by additional Cossacks.

There are conflicting accounts of what happened next. One that hasn’t been reported before describes a man in a yellow full face helmet firing a stainless steel or chrome revolver. The man has never been identified although CNN does possess a photo of a yellow full face helmet sitting in the grass.

5 ways crossbows are becoming more like firearms

Bows and guns fall into two separate categories and always have.  However, as shoulder-mounted crossbows gain both state-legality and market-share popularity, the apples-and-elephants line between bows and firearms narrows a bit.  Gone are the days of heavy, gritty, creepy, slap-me bow triggers and awkward open pin sights.  Accuracy and range are supplanting dual-cam and let-off as archery buzzwords.

Here are five crafty ways crossbow manufacturers are borrowing a page from firearms design manuals to make their tools more appealing to a hungry gun audience.

1. Triggers

One of the biggest advancements in the crossbow market over the last few years has been the trigger.  For years, it was once acceptable for bows to sport creepy, gritty, 7 pound-plus friction-driven triggers. Then somebody realized the importance rifle shooters place on crisp, light triggers and the impact a quality trigger can have on accuracy.

After trigger time with all of the major crossbow manufacturers, three stood apart from the rest: Carbon Express Intercept line, Scorpyd’s 2014-15 models, and the Killer Instinct Machine.  The CE Intercept Supercoil breaks at 3.4#.  The Scorpyd is high quality in all aspects of construction and innovation, though their triggers stood out in both test models, breaking between 2.9 – 3.4 pounds, crisp and clean.  The best of the bunch was a surprise from Killer Instinct with the guaranteed 2# frictionless Trigger Tech trigger on their new-for-2015 Machine crossbow.

2. Adjustable furniture

Crossbow companies tore the page right out of the book of AR-rifle design when it comes to crossbow furniture.  There are collapsible buttstocks and adjustable, interchangeable pistol grips, storage in the grips, and customizable forends. If that’s not enough, the furniture come in every camo and dip pattern of which you can think.  For instance, the Carbon Express Intercept Axon actually uses a multi-position AR buttstock, as do bows from Kodabow, Southern Crossbow, and Parker.  Likewise,  Killer Instinct’s Machine wears the industry’s first side-folder.  Both Carbon Express and Killer Instinct utilize AR-pistol grips that can be interchanged with any AR-grip of the user’s choosing.  Both also feature fully adjustable forends that ride on a picatinny rail.

3. Picatinny rails

Speaking of picatinny rails, gun owners are so accustomed to seeing these tactical rails on everything these days, they barely blink an eye. But who’d ever think picatinny rails would find their way onto bows?  Crossbow manufacturers are including top rails and bottom, front and back.  The Carbon Express Intercept Axon is the first crossbow to feature a long picatinny rail running the entire length of the barrel.  The variety of tactical rails not only provide multiple scope mounting positions, but also allow for lights or backup sights on the top, adjustable handguards and bipods underneath, and even buttstocks that adjust along the lower rear rails.   So much for “gray-is-the-new-black”; now, customizable is the new everything.

4. Reverse draw / Reverse limb technology

Forget everything you ever knew about bows.  Heck, you probably won’t even recognize these creatures, but they are likely the future of crossbows.  Scorpyd is leading the way with what they call “Reverse Draw Technology,” wherein the riser and limbs are reversed and the string is on the leading edge of the bow.  Not only is the balance of a reverse-style crossbow phenomenal when compared to the front heavy counterparts, but the significant increase in power stroke length equals incredibly faster bolt speeds.

For instance, Scorpyd’s latest crossbow launches bolts up to 440 fps while an average standard crossbow clocks in around 325-365 fps.  That also equals flatter trajectory. Rifle shooters are quick to name the flattest shooting cartridges and the true old adage: speed kills.  In addition to Scorpyd, both the Barnett Raptor and now-Ten Point-owned Horton Storm are high on the reverse-crossbow market.

5. Crossbow-specific optics

Those picatinny rails are there for a reason—built to hold not only accessories but also quality optics.  As crossbows increase in power and speed, they become capable of achieving penetration at longer ranges.  Crossbow manufacturers are creating the perfect storm for drop-compensating reticles in 2x, 3x and 4x crossbow optics.  The majority of crossbow packages include scopes of variable power, many of them illuminated in red and green with various intensities for dusk and dawn hunting situations.  Not all standard package optics are created equally and most major optics manufacturers are tapping into the fast-growing market with higher dollar, higher quality options.

Check out the Nikon Bolt, Vortex Viper XBR, Zeiss Terra and Leupold Crossbones. Remember that crossbow “recoil” is quite the opposite of a rifle’s rear-recoiling power and optics are built accordingly.

Thwack! Conclusion

Crossbows do not compete “ballistically” with firearms.  That’s not the point.  Crossbows are, however, incorporating more and more features that were once firearm-specific.  Don’t get me wrong.  I’m first and foremost a compound bow hunter, and yes, I find crossbows to be an unfair advantage when compared with traditional vertical bows. However, love them or hate them, crossbows will own a large share of the market.  Heck, I own one myself, greatly enjoy shooting it, and crossbows have their place in any arsenal.  For gun hunters on the fence about crossbow hunting, this is the perfect segue.  Besides, anything that gives you reason for a longer hunting season has got to be good, right?

How Everytown’s background check law impedes firearms safety training and self-defense

Today, many gun control advocates are pushing for what they call universal background checks. In this and future articles, I will explain the strange system of “universal background checks” being promoted by Michael Bloomberg’s Everytown for Gun Safety lobby. These laws  severely obstruct ordinary activities that do not involve gun sales, such as self-defense and firearms safety training.

Laws based on the Bloomberg system have been enacted in Colorado, Oregon and Washington. They will be on the ballot in 2016 in Nevada, and perhaps in Maine. A similar law (Fix Gun Checks Act, S. 374) has been repeatedly proposed federally by Sen. Charles Schumer (D-N.Y.)

The Bloomberg system applies to every firearms “transfer.” In normal firearms law, a “transfer” means “a permanent exchange of title or possession and does not include gratuitous temporary exchanges or loans.” Chow v. State. 393 Md. 431, 473, 903 A.2d 388, 413 (2006).

However, the Bloomberg laws create a very different definition. For example, the Washington state law says that “ ‘Transfer’ means the intended delivery of a firearm to another person without consideration of payment or promise of payment including, but not limited to, gifts and loans.” Rev. Code Wash. § 9.41.010(25). In other words, it applies to sharing a gun while target shooting on one’s own property, or to lending a gun to a neighbor for a weekend hunting trip.

Under the Bloomberg system, transfers may take place only at a gun store. The transfer must be conducted exactly as if the retailer were selling a firearm out of her inventory. So the transferee (the neighbor borrowing the hunting gun) must fill out ATF Form 4473; the retailer must contact the FBI or its state counterpart for a background check on the transferee; and then, the retailer must take custody of the gun and record the acquisition in her Acquisition and Disposition book. Finally, the retailer hands the gun to the transferee and records the disposition in her Acquisition and Disposition book. A few days later, after the hunting trip is over, the process must be repeated for the neighbor to return the gun to the owner; this time, the owner will be the “transferee,” who will fill out Form 4473 and undergo the background check.

Self-defense

How does this affect the Second Amendment’s “core lawful purpose of self-defense”? (D.C. v. Heller, 554 U.S. 570, 630 (2008)). Under the Bloomberg federal model, there is no allowance for lending a firearm to a citizen in case of emergency. S. 374, § 202(2) (exceptions only for family gifts, inheritances, transfers in the home, and for “hunting or sporting purposes” with various limitations).

Under the proposed Nevada initiative, a firearm may be lent if the loan is “necessary to prevent imminent death or great bodily harm” and the loan “lasts only so long as immediately necessary to prevent such imminent death or great bodily harm.” Whatever “imminent” means, the loan is allowed only as long as “immediately necessary.”
