The Justice Department’s newest electronic dragnet–plane-mounted “dirtboxes” that can slurp thousands of cellular phone ID’s from the air — was originally developed by the CIA to hunt terrorists in the Middle East, The Wall Street Journal reports. Now however, it’s being used domestically to track American citizens. That’s not good.

According to a new report from the WSJ, the US Marshals Service, with assistance from both the CIA and Boeing, developed these Cessna-mounted devices. They are electronic sniffers that mimic cellular tower signals to incite any cellular telephone within range to broadcast its identifying registration information. It’s essentially an aerial man-in-the-middle attack and one that has cost US taxpayers more than $100 million to create. With this information, US Marshals can effectively locate, identify, and lock on to specific cell phones — out of a sample population of thousands or even tens of thousands of devices — to within an accuracy of just three yards. What’s more, once the suspect phone is found, Marshals can then listen in on any calls originating from it. According to the WSJ, these devices have been in operation since 2007, mounted on Cessna aircraft flying out of five metropolitan airfields throughout the US and can access a majority of the US population.

This isn’t the first time that this technology has been put to use by US officials, mind you. Dirtbox technology first debuted in the Middle East where it was utilized in the hunt for terrorists in both Afghanistan and Iraq. However, this new program marks a troubling collaboration between domestic law enforcement and the nation spy agency that blurs a very important operational distinction between the two agencies.

That is, the CIA is an outward-looking agency; its purpose is to gather information from abroad regarding external threats to national security. The US Marshals (and the DOJ in general), instead is tasked with enforcing federal law here in the States. To provide the DOJ with more than a million dollars worth of equipment designed specifically to hunt people that aren’t protected by the Constitution and then allow federal officials to listen in on calls may conform to the letter of the law — as both the CIA and DOJ have asserted to the WSJ — but it certainly doesn’t conform to the spirit. And it could very well lead to further and more aggressive domestic surveillance efforts in the future.

Both the Electronic Frontier Foundation and the American Civil Liberties Union have already filed FOIA requests regarding the program and have requested “additional information about the Department of Justice’s and Department of Homeland Security’s acquisition, possession, and use of cell site simulators deployed on aircraft” ahead of any further legal action.

We’ve already seen that the Feds have very few qualms about utilizing digital dragnets like PRISM. This Dirtbox technology appears to signal a newfound readiness to apply these overreaching information gathering practices to not just our online lives but to our mobile devices as well.

Under intense pressure from majorities in the House and Senate, the National Rifle Association’s huge membership, the Obama administration has abruptly changed course and is rescinding its push to ban popular and cheap ammo used by AR-15 owners.

The Bureau of Alcohol, Tobacco, Firearms and Explosives said 80,000 comments rolled in, many against the proposal to ban the 5.56 M855 “green tip” ammo. The NRA and the other groups still plan to flood ATF mailboxes with opposition letters just to make sure they go through with their withdrawal.

“They’ve gone away for now. We know they’re coming back and we will be ready,” Wayne LaPierre, executive vice president of the NRA, told Secrets.

In a tweet, ATF said, “You spoke, we listened. @ATFHQ plans more study on the proposed AP Ammo exemption framework.” It added in a statement:

“Although ATF endeavored to create a proposal that reflected a good faith interpretation of the law and balanced the interests of law enforcement, industry, and sportsmen, the vast majority of the comments received to date are critical of the framework, and include issues that deserve further study. Accordingly, ATF will not at this time seek to issue a final framework. Lawmakers and the NRA, who warned that the proposal could lead to sweeping ammo restrictions, took credit. It was the NRA that teamed with the chairman of the House and Senate Judiciary committees to collect majorities of members to oppose the bullet ban.

Just Tuesday morning, Secrets reported that 52 senators had joined 238 House members, mostly Republicans, in opposing the ban on the ammunition. Many members believed the proposal was a backdoor effort to impose gun control and limit use of the military-styled AR-15, one of the nation’s most popular rifles but an “assault weapon” liberals want banned.

ATF had proposed banning the ammo in a bid to protect police. They argued that the AR-15 platform is becoming a popular pistol and that police could face attacks as they do with more traditional handguns. Thus, a ban on the ammo would be a lifesaver.

In its “framework” proposal, ATF wrote, “The AR platform is the semi-automatic version of the M16 machine gun originally designed for and used by the military. The AR-based handguns and rifles utilize the same magazines and share identical receivers. These AR-type handguns were not commercially available when the armor piercing ammunition exemption was granted in 1986. To ensure consistency, upon final implementation of the sporting purpose framework outlined above, ATF must withdraw the exemptions for 5.56 mm ‘green tip’ ammunition, including both the SS109 and M855 cartridges.”

However, law enforcement sources said that the agency didn’t realize that the proposal would face such widespread opposition.

Police groups, for example, said the AR-15 pistol, which can weigh five pounds, measure 23-inches long and cost $1,000 or more, isn’t been used against police. Typically cheaper and easy-to-conceal handguns are used in crimes.

What’s more, that round of ammo isn’t used against police, said James Pasco, executive director of the Washington office of the Fraternal Order of Police, the world’s largest organization of sworn law enforcement officers, with more than 325,000 members. “It’s not something that’s necessary at this time,” he told Secrets Tuesday.

And groups like the NRA warned that theBureau of Alcohol, Tobacco, Firearms and Explosivescould take the 5.56 ban and expanded it to any rifle cartridge because virtually all can penetrate soft body armor. Since 1986, most rifle cartridges have been exempted from a ban on armor-piercing ammo because they are used for hunting and target practice, not against police.

“Today’s announcement proves what we have said all along — this was 100 percent political,” said LaPierre. “President Obama failed to pass gun control through Congress, so he tried impose his political agenda through executive fiat. But every gun owner in America needs to understand Barack Obama’s hatred of the Second Amendment has not changed,” he added.

Chris Cox, executive director of the NRA’s lobbying shop, said, “This proposal was never about law enforcement safety – it was about the Obama Administration’s desire to pander to billionaire Michael Bloomberg and his gun control groups. Since they haven’t been able to ban America’s most popular rifle, they are trying to ban the ammunition instead.”

Sen. Chuck Grassley, the Senate Judiciary Committee chairman who authored the Senate letter to ATF, warned that the bullet ban could lead to wider restrictions and a throttling of the Second Amendment. “Second Amendment rights require not only access to firearms but to bullets. If law-abiding gun owners cannot obtain rifle ammunition, or face substantial difficulty in finding ammunition available and at reasonable prices because government entities are banning such ammunition, then the Second Amendment is at risk,” said Grassley’s letter.

She’s got a point about picking off the GOP one by one,and replacing them with people who support the Constitution and BOR.

The only problem with that approach is the amount of time it will take. Sure, we could pick off a few every two years-how long would it take to pick off enough to make a difference?

Leftist governors- Cuomo, Hickenlooper, Malloy, Inslee-have allowed draconian “gun control” legislation to be enacted in their states.

Bloomberg and his minions are getting anti-gun  horsepucky on the ballot in multiple states-they have a list,and are picking off states one by one-no one is doing much about that either-with the exception of a few in Washington state,who have stated,and shown by their actions that they will not comply.

No one  from the GOP has done a damn thing to stop the EPA from enacting regulations to cripple the energy sector through “climate change” related regulations that will force coal powered power plants to shut down.

No one is doing anything about EPA’s attacks on landowners-threatening them with fines of thousands – PER DAY – for doing things like clearing out drainage ditches,or grading a lot so they can build their own home,on their own property-then being told that the lakefront property is a “wetland” and they must restore the land to it’s prior condition. Oh,and they can not build a home on their property either-what kind of bullshit is that?

No one from the GOP did a damn thing about B. Todd Jones being appointed to head the BATFEIEIO-why the hell would they allow an anti-gun zealot to be appointed to the agency tasked with overseeing firearms laws/regulations? We are seeing the results of that poor choice with the M855/SS109 ban.

It appears Lorretta Lynch is going to be the next attorney general-she’s every bit as bad as Holder-yet there’s no meaningful opposition.

Federal agencies are being used by the Obama admin to target political enemies-a bunch of made for the tee vee drama has taken place-but no meaningful action has been taken.

Big win for regulators at Supreme Court

Regulators won a big victory at the Supreme Court on Monday as the justices endorsed expansive powers for changing the interpretation of federal rules.

The Supreme Court ruled 9-0 that federal agencies do not have to follow procedures for notifying the public and collecting comment when changing the interpretations of rules, effectively removing steps from the process that can take months and sometimes years to complete.

The case, Perez v. Mortgage Bankers Association, stemmed from a longstanding Labor Department rule that determines which employees are eligible to earn overtime and minimum wage.

The Mortgage Bankers Association sued after the Labor Department changed its interpretation of the the rule to include mortgage loan officers. The bankers said Labor violated the Administrative Procedures Act (APA) by failing to provide time for provide public notice and time for comment.

But the high court unanimously rejected that argument in an opinion wrote by Justice Sonia Sotomayor.

“Because an agency is not required to use notice-and-comment procedures to issue an initial interpretive rule, it is also not required to use those procedures when it amends or repeals that interpretive rule,” Sotomayor wrote.

The decision contradicts the D.C. Circuit Court’s Paralyzed Veterans doctrine, which holds that an agency must use the APA’s notice-and-comment procedures when it wishes to issue a new interpretation of a regulation that deviates significantly from one previously adopted.

Justice Samuel Alito said the Paralyzed Doctrine likely stemmed from fear that federal agencies were becoming too powerful and concerns that Congress was affording them too much lawmaking authority

“I do not dismiss these concerns, but the Paralyzed Doctrine is not a viable cure for these problems,” he said.

John Meyers, an attorney with Barnes & Thornburg, said the ruling gives the Labor Department, the Equal Employment Opportunity Commission and the National Labor Relations Board a wide berth when it comes to promulgating rules outside of the normal agency rulemaking process, which requires notice, time for rebuttal and comment considerations from constituent groups.

“We can expect the current administration to use this ruling to back up its authority to pass new or change existing precedents,” he said.

(Reuters) – British and Chinese scientists say they have developed a new paint that can be applied to clothes, paper, glass and steel to make resilient surfaces that can self-clean even after being scratched or scuffed.

In research published in the journal Science on Thursday, the scientists said the paint, made from coated titanium dioxide nanoparticles, is extremely repellent to water but, unlike other waterproof coatings, continues to work even when damaged or exposed to oil.

Because it is so hard-wearing, it could be used for a wide range of applications, from clothing to cars.

“The biggest challenge for self-cleaning surfaces is finding a way to make them tough enough to withstand everyday damage,” said Claire Carmalt, a professor of inorganic chemistry at University College London, who co-led the research.

“The surfaces tend to be mechanically weak and so rub off easily. But by pairing our paint with different adhesives, we’ve shown it is possible to make a robust self-cleaning surface.”

In their experiments, Carmalt’s team used different coating methods to create repellent surfaces, depending on the material.

To coat glass and steel, they used a spray-gun, for cotton wool they used dip-coating, and for paper a syringe.

“Being waterproof allows materials to self-clean, as water forms marble-shaped droplets that roll over the surface, acting like miniature vacuum cleaners picking up dirt, viruses and bacteria along the way,” said Yao Lu of UCL’s chemistry department, who co-led the study.

“For this to happen the surface must be rough and waxy, so we set out to create these conditions on hard and soft surfaces by designing our own paint and combining it with different adhesives.”

The team’s results showed that in all cases, the materials became waterproof and self-cleaning, with water droplets of different sizes bouncing off them and taking dirt with them. This continued even after the materials were scratched with a knife or scuffed with sandpaper.

Russian President Vladimir Putin says he began maneuvering to annex Crimea about a month before Moscow officially seized the former Ukrainian peninsula last March. That revelation comes from a documentary clip that aired Sunday on state-run TV in which Putin discusses behind-the-scenes political machinations from a Feb. 22 meeting.

“I invited the leaders of our special services and the Defense Ministry to the Kremlin and gave them the task of saving the life of the Ukrainian president, who simply would have been liquidated,” Putin said, according to The New York Times. “We finished about seven in the morning. When we were parting, I told all my colleagues, ‘We are obliged to begin working to bring Crimea back into Russia.'”

That would contradict Putin’s past assertions that Russia remained impartial until Crimea voted to secede from Ukraine in late March. Putin also initially denied Russian troops had entered Crimea ahead of the referendum, though he later admitted that wasn’t quite true. Jon Terbush

FWC Bear Hunting Proposal Lacks Science

The Florida Fish and Wildlife Conservation Commission’s trophy bear-hunting proposal is devoid of scientific merit. Eight scientific studies, including one published in 2014, have found no evidence that hunting to reduce the bear population would result in fewer human-bear conflicts, unless such a high number of bears is killed that the populations are no longer viable. Many more studies emphasize that employing non-lethal co-existence techniques such as using bear-proof trash cans in bear zones along with code enforcement can successfully resolve human-bear conflicts.

Kate MacFall, Florida state director for The Humane Society of the United States, said: “The best available science overwhelmingly demonstrates that bear hunting does not reduce human-bear conflicts or make people safer. FWC should stop misleading the public by suggesting otherwise. Instead of bowing to the pressure of a vocal minority of trophy hunters, policymakers should use the right tools for preventing conflicts—like bear-proof trash management, public education, hazing, habitat conservation, and code enforcement—strategies that have broad public support and benefit both people and bears.”

According to one study, hunting does not reduce conflicts because hunters generally remove non-problem bears from the population. Instead, hunters target large bears deep in the woods, all for an impressive trophy.
