Fairfax, VA -(AmmoLand.com)- At a time when it’s more important than ever to maintain the right of the American people to keep and bear arms for self-defense, law professor David S. Cohen is calling for repeal of the Second Amendment.

“Americans’ rights are in mortal danger,” he says, unless Hillary Clinton is elected president and stacks the Supreme Court with progressive judges.

In the repeatedly discredited rag, Rolling Stone, Cohen writes, “sometimes we just have to acknowledge that the Founders and the Constitution are wrong. This is one of those times. . . . The Second Amendment needs to be repealed because it is outdated, a threat to liberty and a suicide pact.”

By “outdated,” Cohen means that the Framers of the Bill of Rights were unable to conceive of 19th century semi-automatic firearm technology. “When the Second Amendment was adopted in 1791, there were no weapons remotely like the AR-15 assault rifle (sic),” he said.

However, as the late, great Justice Antonin Scalia wrote in the Supreme Court’s decision in District of Columbia v. Heller, “Just as the First Amendment protects modern forms of communications and the Fourth Amendment applies to modern forms of search, the Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding.”

And in any case, there is nothing outdated about the underlying principle of the Second Amendment: to prohibit the government from interfering with the ability of people to acquire, possess and develop proficiency with arms they might one day need to defend themselves and their loved ones.

Cohen’s rant is just one example of an astonishing amount of sheer nonsense that has filled the Internet since the terrorist attack in Orlando. Anti-gun politicians, and so-called opinion columnists and TV talking heads – who pretend to be “experts” on every topic under the sun, but who in reality know virtually nothing about even one topic – are confidently calling the AR-15 an “automatic” weapon, a “military” weapon,” and a “weapon of war,” and telling everyone that the most popular rifle in America should be banned.

Of course, the First Amendment protects the right of pundits to demonstrate that the size of their egos are only matched by the depth of their ignorance on firearms and the Second Amendment. And so it should be.

If history repeats itself, the recent slew of half-baked, culture-war-based, ideologically-motivated, attention-seeking statements against guns will only increase support for the right to arms, and additional support may develop as people increasingly realize that President Obama and Hillary Clinton, who are urging gun bans, are the very politicians most responsible for the rise of overseas terrorist groups who inspire and possibly direct evildoers within our midst.

All the more reason for the American people to protect their right to protect themselves.

The goal of the group will be to push national adoption of the same universal background checks that have failed in California, Colorado, Washington state, and Paris. In fact, Petraeus will be pushing the same background checks that Giffords’ attacker passed in order to acquire the gun he used to wound her on January 8, 2011.
According to The Hill, Kelly announced the launch of the group by talking about military members’ commitment to “protect our constitution and homeland.” He suggested political leaders now need to step up and “do more to protect our rights and save lives.”
Kelly did not mention that more lives are lost in parts of the country where gun control is most stringent–places like Chicago–nor did he explain how passing more laws that interfere with the exercise of Second Amendment rights is somehow akin to protecting those rights.
In addition to Petraeus, former CIA director Michael Hayden and retired Admiral Thad Allen have pledged to push for more gun laws with Mark Kelly.

It just became much harder to buy a gun through Facebook.

Although Facebook itself doesn’t sell guns, it has wrestled for years with the right way to handle sales of regulated goods such as firearms, adult toys and prescription drugs on its social-media network.

On Friday, the firm changed its policy regarding firearms, banning any such peer-to-peer sales on its network. That means users can no longer offer or coordinate the private sale of firearms on the site. This policy also applies to the sale of gun parts and ammunition, said a Facebook spokeswoman.

That’s far more strict than the company’s previous policy.

Two years ago, the company announced it would treat the sales of firearms in the same way it handles alcohol, tobacco and adult products. Under that policy, those selling firearms were sent a message reminding them to comply with all rules and regulations. It also restricted access to those posts to users older than 18 and displayed an educational message to anyone who searched for firearms sales on Facebook or Instagram, which the company owns. In general, advertisers also are not allowed to boost advertisements that feature regulated goods on Facebook.

The new policy brings the regulation of firearms sales in line with the company’s bans on the sale of marijuana and prescription drugs on its network. If Facebook detects any posts that violates the new directive, it will review the posts and remove them, if necessary.

When Facebook first addressed its firearms policy in March 2014, it was in part at the behest of groups such as Moms Demand Action for Gun Sense in America and Mayors Against Illegal Guns. According to the company, it decided to make this latest change in response to the way commerce has evolved on the network since then.

“Over the last two years, more and more people have been using Facebook to discover products and to buy and sell things to one another,” said Monika Bickert, Facebook’s head of global product policy. “We are continuing to develop, test and launch new products to make this experience even better for people and are updating our regulated-goods policies to reflect this evolution.”

Still, the new policy does allow licensed firearms retailers to post about their goods and services on Facebook. However, they must complete any such transactions off the network.

Facebook did not have data on how many sales are completed this way.

The policy change encouraged some gun-control advocates, who see it as a way to crack down on transactions that potentially violate regulations on firearms sales.

“We spoke with Facebook regarding this important new policy decision, and I appreciate the company’s willingness to work with my office over the past two years on this issue,” said New York Attorney General Eric T. Schneiderman. “Today’s announcement is another positive step toward our shared goal of stopping illegal online gun sales once and for all.”

The National Rifle Association did immediately respond to a request for comment.

Once again, President Obama has chosen to engage in political rhetoric, instead of offering meaningful solutions to our nation’s pressing problems.  Today’s event also represents an ongoing attempt to distract attention away from his lack of a coherent strategy to keep the American people safe from terrorist attack.

The American people do not need more emotional, condescending lectures that are completely devoid of facts.  The men and women of the National Rifle Association take a back seat to no one when it comes to keeping our communities safe.  But the fact is that President Obama’s proposals would not have prevented any of the horrific events he mentioned.  The timing of this announcement, in the eighth and final year of his presidency, demonstrates not only political exploitation but a fundamental lack of

seriousness.

The proposed executive actions are ripe for abuse by the Obama Administration, which has made no secret of its contempt for the Second Amendment.  The NRA will continue to fight to protect the fundamental, individual Right to Keep and Bear Arms as guaranteed under our Constitution.  We will not allow law-abiding gun owners to be harassed or intimidated for engaging in lawful, constitutionally-protected activity – nor will we allow them to become scapegoats for President Obama’s failed policies.

Stop Hiding Behind the Second Amendment

The Second Amendment does not protect an individual’s right to own a firearm. This narrative was developed by the National Rifle Association in the late 1970s, out of fear that further gun control laws would eliminate private ownership of firearms altogether.

For 200 years following the ratification of the Second Amendment, federal judges understood that the Second Amendment safeguarded the right to keep and bear arms when serving in a state militia. This view was widely held until the 1980s when pro-gun organizations began claiming that federal regulation of the individual use of firearms violated Americans’ Second Amendment rights.

Initially, the National Rifle Association dealt more with sport than politics. “I do not believe in the general promiscuous toting of guns,” said Former NRA President Karl Frederick in 1934. “I think it should be sharply restricted and only under licenses.”

In response to increasing crime, a 1968 federal law prohibited interstate firearms transfers except among licensed manufacturers, dealers, and importers. The NRA became scared that more restrictions would ultimately result in government seizure of all personal guns. That’s when, in 1977, the group reorganized to launch an aggressive anti-gun control movement based on a fabricated understanding of the Second Amendment. Those who invoke the Second Amendment as an absolute reason why the United States can’t act like Great Britain, Australia, Japan and other countries to reduce staggering gun violence don’t understand the amendment at all.

When the thirteen colonies broke away from tyrannical Great Britain to form the United States of America, the concern that this new government would become corrupt was very real. The ultimate check on a tyrannical government, the Framers of the Constitution believed, was an armed population.

The Second Amendment reads, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed.” Since militias are made up of citizens bearing arms, gun proponents argue that the right to keep and bear arms naturally extends to each citizen, who may use a firearm for traditionally lawful purposes, such as self-defense within the home.

For the first time in history, this perspective was supported in the 2008 Supreme Court case District of Columbia v. Heller. A civilian, the Court ruled, has a constitutional right to keep a handgun in his or her home for purposes of self-defense.

Nowhere in the text, however, is it stated that an individual right to keep and bear arms is preserved. More overtly, the text refers to the collection of people who would make up a militia if the federal government were to abuse its power.

Today the Cato Institute published my monograph “The Costs and Consequences of Gun Control.” The policy analysis examines several gun control proposals which have been promoted by the Obama administration and the gun control lobby: bans on so-called assault weapons; bans on standard magazines; confiscation; and the prohibition of all private sales, loans and returns, except when processed by a gun store. After explaining why each of these proposals is likely to do little good and much harm, the paper discusses realistic alternatives which really can save lives. The most important of these is providing a much broader safety net for people seeking help for severe mental illness. In addition, respecting the right to bear arms has been demonstrated to be successful in thwarting would-be mass murderers.

Prohibiting certain guns or magazines will be futile without confiscation of such arms currently owned by citizens; so said a 2013 memo by Greg Ridgeway, acting director of the National Institute of Justice (the research arm of the Justice Department). Likewise, the NIJ memo explained that “universal” background checks are useless without comprehensive registration of all guns and all gun owners. Yet Americans have historically resisted gun registration, precisely because of concerns about confiscation. These concerns are not unfounded; registration lists have been used to enforce confiscation in New York City, in Australia and in Great Britain. In Australia, the confiscation was euphemistically called a “buy back,” although it was in fact involuntary confiscation, with only partial compensation paid for the confiscated items.

The Metropolitan Police have launched a two week gun surrender, urging members of the public to hand in lawfully owned ” imitation weapons, BB guns and air weapons”.

There are no restrictions on owning imitation firearms or BB guns, though you must be 18 to buy them. Airguns are subject to some of the controls on firearms, mainly on having a clean criminal record.

Coming on the heels of the EU gun ban proposals, the recent attack on Paris and the seemingly thwarted attack on Brussels, demanding that innocent people hand over lawfully owned toys is a pathetic response.

The Met insists that people handing over firearms (or, indeed, children’s plastic toys, which if coloured black or grey now fall under the classification ‘realistic imitation firearm’) “may not face prosecution for illegal possession and can remain anonymous”, though immediately continues its statement by saying “some weapons [will be] forensically checked for evidence”.

Actual firearms can also be handed in to local police stations during the surrender.

The term ‘surrender’ is used in order to allow police to mount prosecutions against people who hand in firearms or toys. Previously such initiatives were labelled ‘amnesties’, which UK Shooting News understands implied immunity from prosecution.

Detective Superintendent Stephen Clayman of the Trident and Area Crime Command said, in a canned press release: “We are asking Londoners to hand in firearms and imitation weapons to avoid them falling into the wrong hands. In an inappropriate setting, imitation weapons will cause fear and panic, and could lead to a police response involving the deployment of armed police officers, with potentially tragic results.”

UKSN’s standard advice if you have an unwanted firearm or come into possession of one, for example through an elderly relative’s death, is to contact your local gun shop immediately. Registered Firearms Dealers will in most cases be quite happy to help you safely and lawfully dispose of firearms without exposing you to the risk of overzealous police employees trying to make you into their next arrest and conviction statistic.

In 2009 Surrey Police arrested a man who found a shotgun in his garden and took it to his local police station for unlawful possession of a firearm. He was later convicted of the offence, which carries up to 5 years in prison – but escaped with a suspended sentence. Unlawful possession is a strict liability offence, meaning your intentions count for nothing in court.

“So you’re a Constitutionalist? We’ve had problems with this before!”

Long Valley, CA — Last month, the Feinman family was driving through a constitutionally questionable interstate checkpoint. This checkpoint is not on the US/Mexican border; it is along Highway 395N between California and Nevada.

When driving through these in-country checkpoints, you are not required to answer the agent’s questions (usually starting with “Are you a United States citizen?”). Nor are you required to consent to any searches.

As the Feinman’s drove through, they refused to be unlawfully searched, citing their 4th Amendment right to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.

The agents, however, could have cared less about the Feinman’s rights, stating at one point that “this is my job.”

When the family refuses to back down, government force is escalated, and police officers are called in to violate the Feinmans even further.

As Mr. Feinman asserts his rights, he is threatened with being pulled out of the vehicle and having his children taken from him by CPS.

Mr. Feinman says he’d like to go, but these officers are determined to extort money from him (issue a citation) for flexing his rights. When he asks the cops if they swore an oath to defend the constitution, the cop asks, “So you’re a Constitutionalist?”

When Feinman confirms that he is a constitutionalist, the officer responds, “We’ve had problems with this before.”

At around the 13-minute mark, Feinman is issued an ultimatum, submit or have your window broken and we kidnap your entire family. During the process, these officers acted as if it were Feinman’s fault when all he was doing was refusing an illegal search.

Police acted as if some magical force compelled them to have to break the window and drag a family out of their vehicle. However, the fact of the matter is, they could have just let them travel freely.

Eventually, the window is smashed out, and all occupants were arrested, and the child was taken by CPS. According to the Feinman’s, they were then given an excessive bail amount to get out of jail.

This entire incident was over Mr. Feinman not wanting to be searched at the checkpoint. Referring to an illegal search as an “inspection” does not change the reality of the act.

What this video below highlights is the only tool the state has to force you to comply with their revenue generating and rights-violating police state measures — violent escalation. Comply or we kidnap, cage, or kill you.

BALTIMORE —Amid an unrelenting streak of violence, Baltimore’s mayor said current gun laws miss the mark.

The number of homicides in Baltimore reached 211 on Wednesday, matching the number for all of last year. The 211th homicide was recorded when police found the body of a man who was shot in a vacant house in the Penn-North neighborhood of west Baltimore, the same area hit by riots in April.

Mayor Stephanie Rawlings-Blake’s political career may depend on getting the violence under control. She gave credit Wednesday to city police officers because arrests are back up to a normal pace. She suggested that it doesn’t matter that Maryland has some of the toughest gun laws on the books while other states don’t.

Not since the 1990s has the city seen this many homicides this soon in a given year. In 2007, the city recorded its 200th homicide on Aug. 20 and went on to 282 homicides for that year.

At City Hall on Wednesday, Rawlings-Blake said the city’s violence follows what she called four strands of rivalry and retaliation.

“There are four major strands that are impacting the homicide rate in Baltimore. We can trace it and we can trace the players,” Rawlings-Blake said. “There are known entities who are battling it out on the streets like is this is the wild, wild west, and we need help.”

The mayor implored people with information to come forward.

“If you know someone who is involved in this, who you know are either the next victim or the next perpetrator, if you don’t want to see your loved one die in the streets, we need you to help us do something, because if they are involved in these strands, it’s coming,” Rawlings-Blake said.

Citing similar increases in violence in other cities, the mayor called for a national response, including a controversial target: tougher federal gun laws. She acknowledged that Baltimore’s violence surges on despite Maryland’s gun laws, some of the toughest in the country. The problem, she said, is that laws in other states are more lax.

“What I am saying (is) the current approach, the state-by-state approach, has not been effective,” Rawlings-Blake said.

On another front, concern about a police slowdown in Baltimore seems to have eased. Between July 15-31, city officers made 1,318 arrests, nearly double the 771 arrests that officers made between May 15-31, right after charges were announced in the Freddie Gray case.

“We are seeing a lot of positive indicators that officers are engaged on every level, and the concerns that were raised, that things are turning around,” Rawlings-Blake said.

The recent arrest numbers are much closer to the level of arrests before Gray’s death.
