MILFORD, Pa. (Reuters) – The Pennsylvania survivalist who eluded a 48-day manhunt after a sniper attack that killed one state trooper and wounded another pleaded not guilty on Thursday to murder charges.

Eric Frein, 31, appeared at his arraignment through a video conference from Pike County Correctional Facility, where he is being held without bail.

He was asked by Judge Greg Chelak in the Pike County Courthouse whether he wanted to plead not guilty to fatally shooting Corporal Bryon Dickson and wounding Trooper Alex Douglass on Sept. 12, 2014 during a late night shift change at the Blooming Grove state police barracks.

“That’s what I wish,” Frein said in a firm voice, standing tall and still in an orange jumpsuit.

Pale, clean shaven and looking almost bookish, far from the bedraggled man he appeared at the time of his arrest, he repeatedly answered the judge’s questions about whether he had seen paperwork with a polite, “Yes, I have” and “Yes, I do.”

If convicted of the top charge of first-degree murder, Frein could face the death penalty.

Asked outside the courtroom about the possibility of a plea bargain to spare Frein from a death sentence, District Attorney Ray Tonkin, said he was “not considering a plea at this time.” He declined to discuss the case further.

Prosecutors have said Frein harbored anti-government views for years and hoped the shootings would spark a “revolution.”

After the gun violence, Frein, who lived at his parents’ home not far from the ambush site and is an experienced outdoorsman, fled into the surrounding Pocono Mountains, about 100 miles north of Philadelphia. The FBI put him on its Most Wanted List and an intensive manhunt put the community on edge for weeks – at a cost of $11 million.

He was captured by U.S. Marshals outside an abandoned airplane hangar in a former resort near Tannersville, Pennsylvania.

Judge Chelak added Frein to the March trial list but defense lawyer Michael Weinstein said he believed the case would not go to trial before 2016.

Starting out quoting Shakespeare and ending up citing Kafka, Judge Francis M. Allegra’s conclusions about ATF conduct that led him to rule in favor of retired agent Jay Dobyns in a breach of covenant suit are scathingly revealed in his previously sealed opinion. That judgment was revoked after Allegra learned of “fraud upon the court” considerations, this column reported Sunday.

Leading his opinion with a verse from Othello, Allegra pointedly let the government defendants he ruled against know he considered them to have robbed Dobyns of his “good name.” Concluding his opinion with a reference comparing Dobyns’ ordeal to that imposed by the ‘totalitarian state” in “The Trial,” and calling it “Kafkaesque,” Allegra further observed that the conduct of “certain ATF officials … bears little resemblance to the lofty sayings carved into the facades of the Department of Justice.” He was referring to “words now carved into the office rotunda of the Attorney General” that “The United States wins its point whenever justice is done its citizens in the courts.”

“Based on the breach of the covenant, the court finds that plaintiff [Dobyns] is entitled to damages in the amount of $173,000,” Allegra ordered in the opinion he has since revoked in order to pursue an investigation into further government misconduct. “The court concludes that defendant [ATF] is entitled to – nothing.”

Contained between such surprisingly literary judicial bookends is much “legalese,” and much “backstory” that in many cases reads more like a novel than like a record of dry facts. It’s almost surreal when figures from Operation Fast and Furious appear in this account, and they act in character consistent with how they established themselves in that story. This time, with additional “cast members” (and the legal document at times reads just like a script), the technique of “slow walking” (as in deliberately dragging their feet investigating the arson of Dobyns’ home) brings to mind another “walking” technique employed by ATF in that other installment of the bureau’s directed misadventures.

The chairman of the National Committee of the Communist Party USA has penned a 2,023-word manifesto making the critical point that American Communists are eager to work with the Democratic Party to advance the modern communist agenda and achieve communist goals.

Communist Party chairman John Bachtell published his essay last week at People’s World, a “daily news website of, for and by the 99% and the direct descendant of the Daily Worker.”

“[L]abor and other key social forces are not about to leave the Democratic Party anytime soon,” Bachtell promised. “They still see Democrats as the most realistic electoral vehicle” to fight against perceived class enemies.

Bachtell, 58, is playing the long political game and he has a strategy, he said.

“First, we are part of building the broadest anti-ultra right alliance possible, uniting the widest array of class (including a section of monopoly), social and democratic forces. This necessarily means working with the Democratic Party,” the communist leader explained.

“Second, our objective is not to build the Democratic Party. At this stage we are about building the broad people’s movement led by labor that utilizes the vehicle of the Democratic Party to advance its agenda,” Bachtell further expounded. “We are about building the movements around the issues roiling wide sections of people that can help shape election contours and debates.”

“[W]e are for building movements in the electoral arena and see engagement in the electoral arena and democratic governance as a vital means to further build movements,” Bachtell also said.

To that end, he claimed, “thousands of trade unionists have been elected” at municipal and local levels of American government. Bachtell did not note a party affiliation of these elected leaders.

The rest of Bachtell’s declaration is mostly a somewhat modernized version of the same, garden-variety communist drivel communists have been spouting since roughly 1840.

Communists and other leftists have experienced “disillusionment with the Democratic Party” because of its “deep connections to Wall Street.” He is still mad at President Bill Clinton for NAFTA and welfare reform.

He’s mad at everyone about an increased number of private schools.

Republicans are an embodiment of caricatured evil for Bachtell.

“While the Republican Party is led by the most reactionary sections of Wall Street capital including the energy extractive sector and military industrial complex, it also consists of extreme right-wing elements including the Tea Party, white supremacists, social conservatives, right-wing evangelicals, climate deniers, anti-reproductive rights groups, etc.,” the communist leader writes.

Bachtell possesses a bachelor’s degree from Antioch College, an obscure, private hothouse of leftism that went defunct in 2008 and was resurrected in 2011 as an unaccredited, private work college.
